WAEMU Court of Justice Rules Sanctions Against Mali in 2022 Illegal
In its ruling, the Court of Justice of the West African Economic and Monetary Union (WAEMU) annulled the decisions adopted on January 9, 2022, by the heads of state of WAEMU, stating that they were "devoid of legal basis."
The WAEMU, due to its "monetary and economic vocation," did not have a clear legal foundation to endorse and implement sanctions decided within a political framework by ECOWAS, according to the court ruling.
ECOWAS and WAEMU imposed sanctions on Mali between January and July 2022. The sanctions were intended to pressure the military government to adopt an electoral timetable.
Denouncing these sanctions as "inhuman and illegal," Bamako filed a petition for annulment with the WAEMU Court of Justice as early as February 2022.
In August 2023, Niger also filed a similar petition, which is still pending before the court.
